Immigration Law - What You Must Know About the Save Act

Bookmark and Share

SAVE Act, Congress now being considered, would require all employers to electronically verify each employee's eligibility to work. Although this law is considered, it is now more important than ever for this country to assess its stance on illegal immigration.

While the SAVE Act has many positive effects, if passed will put off the job about 20 million undocumented immigrants. This will open many jobs for the struggling American citizens, but to pay many of these people are not considering.

During the Bush administration tried to secure U.S. borders from illegal immigrants pass, and to make it easier for foreigners to come here to work in the United States on a temporary basis. The emphasis was on nine a guest worker program currently in force, although special attention is paid to the Department of Labor (DOL) to improve the employer's ability to obtain the necessary agricultural labor force through the existing H-2A visa. This visa allows agricultural employers to hire foreign workers to fill temporary positions, provided that certain conditions are met.

The employer must prove that:

 • There is not sufficient workers who are able, willing and qualified, and that will be available at the time and place needed to perform labor or services involved in the petition, and that

 • employment of aliens in such labor or services will not adversely affect the wages and working conditions of workers in the United States similarly employed.

If the employer meets these requirements and then the lawyer must give final approval for employment to begin.

The Bush administration tried to make the H-2A visa is more appealing to employers through several changes. They fall in government involvement in the recruitment process, thus speeding up the application. They require employers to pay for the transport of guest workers from government offices and workplaces, instead of requiring them to pay the passage of workers' home countries. And they are no longer required to carry Employers' recruitment efforts in large geographic regions, in order to show that there were not enough workers to fill positions.

These new regulations give employers incentives to move away from illegal immigrant labor, and give priority to those who came to work through legal means.

These changes were met by strong protivljenja.Farmworkers Justice Foundation have argued that they did not adequately protect workers rights and to pay down public workers so they can compete with guest workers.

Pressures from these arguments led to the administration's nine months of suspension changes. This decision was challenged and overturned 29th June 2009, when a federal judge halted the suspension of the present decision Dol. This solution temporarily maintains the policy created by Bush Dol.

For the United States to be able to secure the border and ease the negative effects of illegal immigration must be a way to provide employers access to foreign labor markets through legal channels. If the SAVE Act to make it through Congress would then become necessary to ensure employers manageable way to get the workforce they need.
